espanolEl silencio del poder publico es una forma de expresion, un significante que revela una intencion en la medida en la que el derecho positivo trata de manifestar y traducir el sentido de este lenguaje especifico. Tradicionalmente, este silencio en el derecho frances equivale al rechazo. La ley del 12 de noviembre de 2013 ha reafirmado la voluntad del derecho positivo de otorgar un sentido al silencio del poder publico, y es por ello que ha decidido cambiar el contenido y concebir una aceptacion. Mas alla del aspecto tecnico de esta reforma, es esencial comprender el alcance, en lo que se refiere a los derechos de los ciudadanos que dicha ley trata de proteger ; de igual manera comprender su impacto, el cual seria discutible en el lugar del interes general de la organizacion social. El legislador ha tomado consciencia al proclamar en realidad a un principio paradoxalmente residual, en consideracion de las excepciones multiples de las cuales es y sera el objeto, cuando el texto habra entrado en vigencia en el mes de noviembre de 2015. francaisLe silence de la puissance publique est une forme d’expression, un signifiant qui revele une intention dans la mesure ou le droit positif entend manifester et traduire le sens ce langage en creux. Au-dela de l’aspect technique de cette reforme, il est essentiel d’en comprendre la portee quant aux droits des citoyens qu’elle entend proteger et d’apprehender son impact, discutable, sur la place de l’interet general dans l’organisation sociale. Le legislateur en a pris conscience, en proclamant en realite un principe paradoxalement residuel au regard des exceptions multiples dont il fait et fera l’objet lorsque le texte sera totalement entre en vigueur, en novembre 2015. EnglishThe silence of the public authorities is a form of expression that signals an intent, to the extent that the positive law intends to make manifest and translate the meaning of this absence of language. Traditionally, this form of silence in French law was equivalent to a refusal. The Act of November 12, 2013, while reaffirming the intention of the positive law to give meaning to the silence of the public authorities, decided to reverse its thrust and to make it an acceptance. It is essential to understand, in addition to the technical aspects of the reform, its impact on the rights of citizens it is designed to protect, as well as its questionable impact on the role of the general interest in social organization. The legislator is aware of this, and has in fact introduced a paradoxically residual principle concerning the multiple exceptions that will be specified when the Act takes full effect in November 2015.
