Abstract

En Colombie-Britannique (Canada), le projet d’extension de l’oléoduc TransMountain et le projet de construction du gazoduc Coastal GasLink ont suscité de vives contestations. Les opposants à ces projets d’aménagement du territoire sont avant tout des groupes d’Autochtones des Premières Nations. Or, les Premières Nations bénéficient de lois particulières en matière d’aménagement d’espaces les concernant. Ces lois obligent le gouvernement du Canada à les consulter sur certains projets. Aussi depuis quelques années la notion de consentement a émergé dans le débat. S’il n’existe pas d’obligation de recueillir le consentement de ces acteurs — à l’exception des projets sur des terres dont les Autochtones détiennent un titre explicitement reconnu — en Colombie-Britannique, la majorité du territoire n’est pas couvert par des traités qui auraient été conclus entre le Canada et les Autochtones. Cela ouvre la voie à des interprétations juridiques qui alimentent des représentations et diverses stratégies. L’objectif de l’article est d’explorer la diversité des positions des Premières Nations dans les conflits portant sur la construction d’oléoducs et de gazoducs, et d’exposer les jeux de pouvoir qui caractérisent ces projets d’aménagement. Pour cela, nous nous appuyons à la fois sur la théorie de l’acteur stratégique, que nous enrichissons d’un volet territorial, et sur l’analyse de systèmes géopolitiques locaux en Colombie-Britannique. Cela permet d’analyser les répercussions de projets de gazoducs ou oléoducs à l’échelle locale.
