Abstract
This study compares the Australian COGSA s11 and the Canadian MLA s46 regulating forum (arbitration or jurisdiction) selection. Even though both provisions favor local claimants and proceedings, differences in the language used and their judicial application may be observed. This has led the author to draw conclusions and formulate suggestions on the rule of law applicable in this field. The study touches upon many different areas of study such as maritime law, comparative law, conflict of laws and outlines policy considerations.
