La loi de 1976 traduit, pour la première fois dans la législation française, l’esprit de ce qu’est la conception progressive d’un projet d’aménagement du territoire, laquelle doit, en premier lieu, chercher à éviter les impacts négatifs de celui-ci sur l’environnement, puis, dans un second temps, à réduire ceux qui n’ont pu être évités, en adaptant techniquement le projet. Enfin, pour la fraction des impacts résiduels, il s’agit alors de les compenser par une action guidée par l’objectif de non-perte de biodiversité. Bien que renforcée par la loi sur la reconquête de la biodiversité en 2016, cet outil demeure toutefois mal utilisé, puisque le succès de sa mise en œuvre dépend non seulement de l’interprétation des textes normatifs nationaux par les acteurs du territoire (Bigard et al. , 2018) 1 , mais également de l’existence de contrôles et de sanctions. Pour dépasser cette vision, l’approche de la séquence Éviter-Réduire-Compenser (ERC) adoptée par les leviers économiques et financiers semble permettre de dessiner une application plus juste de l’outil considéré afin d’agir en faveur de l’intérêt général.
