Spanish Abstract: Este amicus curiae brindar al Tribunal Constitucional del Peru informacion sobre algunos de los instrumentos internacionales de derecho y de politicas publicas que estimamos resultan relevantes para la decision de este caso lo cual plantea importantes cuestiones con respecto a la constitucionalidad de una serie de contratos de servicios “extraordinarios y complementarios” suscritos entre la compania minera Xstrata Tintaya (ahora Minera Antapaccay) y la Policia Nacional del Peru (PNP) con el objetivo de brindar servicios de seguridad a la infraestructura y el personal asociado a la mina Tintaya (ahora Antapaccay), ubicada en la provincia de Espinar, Departamento del Cusco. Este caso es importante, porque los terminos del contrato Tintaya-PNP son muy similares a los de otros que hemos examinado personalmente, firmados entre companias extractivas extranjeras y la PNP. La Constitucion Peruana protege valores como el Estado de Derecho, la igualdad, la no discriminacion y el derecho de la comunidad a la seguridad. En este amicus presentaremos consideraciones internacionales de derecho y de politicas publicas que senalan la importancia del principio de la imparcialidad de la policia, y su directa relacion en una sociedad democratica con los principios de igualdad, no discriminacion y el Estado de Derecho. En relacion con estas consideraciones internacionales, argumentamos que los contratos entre la PNP y las empresas mineras transnacionales resultan inconsistentes con el principio bien establecido de que el Estado debe brindar servicios de seguridad a sus ciudadanos de manera imparcial y que responda a las necesidades especiales de los miembros mas vulnerables de la sociedad. English Abstract: This amicus curiae brief offers the Constitutional Court of Peru information about some of the instruments of international law and policy that are relevant to the adjudication of a case that raises serious questions regarding the constitutionality of a series of “extraordinary and complementary” services contracts formed between mining company Xstrata Tintaya (now Antapaccay Mining) and the Peruvian National Police Force (“PNP”) with the objective of providing security services to the infrastructure and personnel associated with Tintaya Mine (now Antapaccay), located in Espinar Province in the Department of Cusco. This case is important because the terms of the Tintaya-PNP contract are very similar to a number of other contracts that the amicus authors have personally examined between foreign resource companies and the PNP. The Peruvian Constitution protects values such as the rule of law, equality, non-discrimination and the community’s rights to security. In this amicus, we present international statements of law and policy that establish the importance of the principle of police impartiality and its critical relationship to the principles of equality, non-discrimination and rule of law in a democratic society. Referring to these international statements, we argue that the contracts between the PNP and the transnational mining companies, are inconsistent with the well established principle that the state must provide security services to its citizens in a manner that is impartial and responsive to the special needs of society’s most vulnerable members.
