Abstract
« Un peu de sociologie éloigne du droit et beaucoup de sociologie y ramène. » Cet aphorisme résume le parcours de l’auteur comme professeur de droit. Pendant la première partie de sa carrière, à l’Université Laval, sa spécialisation en sociologie juridique et sa préférence pour une approche externe du droit l’éloignent du droit positif comme objet d’enseignement et de recherche. La seconde partie marque, au contraire, un net rapprochement avec une perspective interne. L’auteur décrit les particularités de son cours de droit des contrats donné pendant douze années dans le contexte du programme transsystémique de l’Université McGill : l’objectif de formation à la pensée juridique critique ; l’attention systématique aux faits sociojuridiques contemporains qui transforment les pratiques contractuelles ; la confrontation dialectique des théories conventionnelles et alternatives du droit des contrats. En rétrospective, l’auteur constate que cette expérience pédagogique est restée profondément inspirée par la sociologie juridique de Georges Gurvitch.
