Abstract

The focus of this paper is on a potential reform that moves the Not Criminally Responsible (NCR) system from provincial to federal jurisdiction. The primary case study is centred around the province of Ontario, the history as well as the limitations of the current system. The current lack of standardization between provinces and the unanswered constitutional questions of federal authority over the NCR system are addressed within this paper. Further, the recent increase in those found NCR coupled with the revealed abuses makes this paper pertinent.
