Abstract
본 논문은 라트비아 건설회사와 스웨덴 건설노조 사이에서 벌어진 새로운 형태의 노사분규인 라발 사례(Laval case)를 중심으로 유럽연합 가입에 따른 유럽 시장통합의 추세와 스웨덴 국내 노사관계 제도 간의 갈등을 분석한다. 라발 사례는 임시파견노동자 고용을 둘러싼 유럽연합의 법이 스웨덴의 노사관계 모델에 미치는 부정적인 효과를 보여주었다. 동시에 라발 사례는 유럽연합과 회원국들 간의 법적 혹은 제도적인 차이의 중요성을 보여주었다. 결론적으로 라발 사례는 유럽화에 의한 시장통합과 유럽화에 부재한 사회적 유럽 간의 딜레마를 보여준다는 점을 논의한다.
