In his new book The Rule of Five: Making Climate History at the Supreme Court, Professor Richard J. Lazarus tells the story of the Supreme Court of the United States’ decision in Massachusetts v Environmental Protection Agency. Professor Lazarus walks readers through much of what happened, from the early work that led to the case being brought to the courts all the way until the political branches’ responses to the Supreme Court’s decision. One can easily learn about Massachusetts v Environmental Protection Agency as a matter of black-letter law by reading the Supreme Court’s decision. But Professor Lazarus goes further by providing a rich contextual analysis that gives readers a more comprehensive appreciation of the case. This leads to several questions, including questions about the relationship (or lack thereof) between litigation and public policy change.
