Abstract
L’essor du rôle des plateformes numériques dans l’économie de partage provoque des effets néfastes sur les consommateurs en raison de la désuétude du cadre réglementaire, sur les plans notamment de la concurrence et de l’exclusion socio-économique. On le constate entre autres dans les secteurs du transport (Uber), des services financiers (sociofinancement) et de l’hébergement (Airbnb). Seule une modernisation en profondeur du droit de la consommation, incluant une redéfinition des concepts fondamentaux de « consommateur », de « commerçant » et de « prix », permettra de pallier des problèmes que la technologie altère ou paraît camoufler, mais ne supprime pas.
