This article examines the modalities through which Canada can fulfill its obligation under the Convention on Biological Diversity for ensuring access and benefit sharing arrangement in the utilization of biodiversity and associated traditional knowledge. The fulfillment of such an obligation requires the recognition and enforcement of the rights of Aboriginal peoples over biodiversity and their underlying traditional knowledge. Canada’s default approach to regulating the use of these resources is based on a private contract-based model. The article argues that the incorporation of disclosure of origin requirements for inventions that utilize biodiversity, as well as implementing a Traditional Knowledge Digital Library system can achieve a degree of protection that will not involve a significant overhaul of the legal system. It is noted that such approaches be guided with culture-specific protocols of protection, ingrained in Indigenous legal traditions.
