Abstract
Dans le cadre du present article, les auteurs presentent un tour d’horizon des differentes conditions d’ouverture associees aux ordonnances de type Anton Piller, Mareva et Norwich, en plus d’aborder certains avantages et enjeux specifiques a l’exercice de ces recours a la lumiere de la jurisprudence rendue, notamment en matiere de propriete intellectuelle. Les auteurs traitent entre autres de l’etendue de l’obligation du demandeur de divulguer au juge les faits pertinents au dossier en matiere d’ordonnances de type Anton Piller, de l’emission d’une ordonnance a portee internationale a l’egard d’un tiers en matiere de protection des droits d’auteurs et de l’utilite de l’ordonnance de type Norwich afin de lutter contre les atteintes indues a la vie privee. Il ressort de la jurisprudence marquante des dernieres annees que la souplesse des ordonnances precitees, conjuguee a la possibilite que leur application depasse les limites du territoire quebecois,les rend particulierement attrayantes afin de lutter efficacement contre la fraude a l’echelle internationale.
