Abstract
Malgre une conception a la base tres materialiste des biens, le droit civil quebecois reconnait depuis plusieurs annees les biens incorporels tels que les actifs de propriete intellectuelle comme objets de propriete. La vision civiliste quebecoise de la propriete se transpose toutefois encore tres mal a ce genre d’actifs et le regime de protection des marques de commerce reflete parfaitement cette realite. A plusieurs egards, les proprietaires de marques de commerce ne beneficient ni de l’ampleur de la protection normalement accordee aux titulaires de droits de propriete sur des biens corporels ni de la panoplie de recours a la disposition de ces derniers. L’omnipresence du numerique dans notre vie vient, de plus, exacerber le fosse entre les droits accordes aux detenteurs de propriete corporelle et ceux accordes aux proprietaires de marques de commerce, remettant parfois en cause le concept meme de propriete. Le referencement web en est un exemple flagrant.
