Abstract
Chez les Innus d’Uashat mak Mani-Utenam, l’institution du ne kupaniem/ne kupanishkuem correspond à ce que l’on peut appeler « adoption » ou « garde coutumière ». En se fondant sur des entretiens avec des membres de cette communauté, le présent texte décrit les principaux traits de cette institution, soit le transfert volontaire de la garde d’un enfant, qui se veut temporaire et qui ne brise pas le lien de filiation d’origine. Le texte fait également état des démarches entreprises pour assurer une juste reconnaissance de cette institution en droit civil québécois. Ces démarches ont conduit à l’adoption de l’article 199.10 du Code civil du Québec , qui attribue les effets de la tutelle supplétive à une situation de ne kupaniem/ne kupanishkuem lorsque celle-ci est certifiée par une autorité désignée par une communauté autochtone.
