This chapter highlights the key trade-related aspects of intellectual property agreement-plus provisions in Free Trade Agreements (FTAs) negotiated by the United States (US) and European Union (EU) to prove the trend towards longer, further, and deeper pharmaceutical patent protection. More specifically, It primarily uses the texts of the tans-pacific partnership, (the name of the agreement prior to US withdrawal) and the EU–Canada comprehensive economic and trade agreement, as these agreements feature the typical provisions negotiated by the branded pharmaceutical industry&s;s two leading proponents. Modern FTAs negotiated by the US and EU go further in seeking to protect the test data separate from – and in addition to – patent protection. Test data protection in FTAs can take one of two forms: test data exclusivity or market exclusivity. Test data exclusivity prevents the regulatory authority from accepting applications from generic applicants which rely on the test data until the exclusivity period ends.
