Abstract
Pada masa pandemi Covid-19 tahun 2020, persidangan di pengadilan dilaksanakan secara daring, yang diatur melalui Peraturan Mahkamah Agung No. 4 Tahun 2020 tentang Administrasi dan Persidangan Perkara Pidana di Pengadilan Secara Elektronik. Di Pengadilan Negeri Palembang Klas IA Khusus, sejak dilakukan Persidangan secara daring ini, untuk posisi para pihak didalam Pengadilan Negeri ialah ada Hakim, Jaksa Penuntut Umum di Kantor Kejaksaan, terdakwa ditempat Tahanan, sedangkan Advokad dikantornya atau bisa mendampingi ditempat terdakwa ditahan. Ketika terdakwa mengikuti persidangan secara daring itu bisa didampingi oleh Advokadnya dan harus mengikuti SOP yang telah ditetapkan Terdakwa tetap berada di dalam tahanan yaitu tahanan pada rutan maupun di Polres yang menangani perkara. Selama pandemi untuk mencegah penularan Corona virus pada Rutan, terdakwa ditahan di Polres yang menangani perkara. Dalam hal pelaksanaan di Rutan / LPKA atau LAPAS, terdakwa menggunakan meduia video call yang telah disediakan oleh pihak LPKA/ RUTAN. kendala dalam pelaksanaan persidangan perkara pidana secara elektronik pada masa pandemic Covid 19 di Pengadilan Negeri Kota Palembang adalah sarana prasarana, akses internet pemenuhan hak terdakwa dan penerapan asas Sistem Peradilan Pidana. Saran yang dapat diberikan dalam pelaksanaan persidangan perkara pidana secara elektronik adalah diharapkan dibentuk suatu peraturan undang-undang yang mengatur mengenai Persidangan pidana daring di masa tertentu. Agar pelaksanaan persidangan perkara pidana secara elektronik berjalan dengan lancar , taat asas sesuai dengan system hukum yang berlaku di Indonesia, dan diharapkan dibentuk satu tim khusus yang terdiri dari para penegak hukum baik di pengadilan, kejaksaan maupun di Lembaga Pemasyarakatan agara persidangan perkara pidana secara elektronik berjalan dengan lancar.
