Abstract
El trabajo aborda la cuestión de la legitimidad del derecho a partir del funcionalismo, comparando los conceptos de subjetividad en las visiones de Luhmann y Habermas y de cómo puede haber una verdadera democracia en las actuales sociedades. Se toma en consideración cómo debe darse la actuación subjetiva para alcanzar esa legitimación jurídico-democrática.
