Abstract

Penelitian ini bertujuan untuk mengetahui penyebab terjadinya sengketa tapal batas di Distrik Moraid Papua Barat. Kecenderungan masyarakat Adat Distrik Moraid dalam aktivitas sehari hari dan dalam pelbagai hal termasuk proses penerimaan pelayanan dan pengurusan surat menyurat tentang kependudukan sebagian masih dilayani oleh Pemerintah Daerah Kabupaten Sorong sebagai Kabupaten Induk. Menggunakan Pendekatan yuridis sosiologis (Z.Ali,2014) adalah dengan tujuan melihat dan menganalisis aspek aspek hukum yang terjadi dalam masyarakat serta mengidentifikasi masalah yang terjadi. Hasil penelitian ini menunjukkan bahwa sengketa tapal batas di Distrik Moraid adalah menjadi beban dan tanggung jawab Dewan Adat yang harus diselesaikan secara transparan dan terbuka kepada masyarakat tanpa ada kepentingan dan intervensi dari Pemerintah Daerah kedua wilayah, sehingga dalam keputusan Dewan Adat dapat menjadi rujukan perdamaian dan solusi bagi pihak pihak yang bertikai sesuai dengan kaidah hukum adat dan nilai nilai kearifan lokal yang berlaku.Atau jika belum memenuhi harapan maka dapat melakukan gugatan melalui Pengadilan Tata Usaha Negara dan Mahkamah Konstitusi.
