Abstract
Constatant l’absence de protection explicite contre la discrimination fondée sur le poids dans la Charte des droits et libertés de la personne du Québec, l’autrice étudie la jurisprudence ayant mobilisé les motifs du handicap et du sexe dans des cas de discrimination fondée sur le poids en milieu de travail. Elle examine ensuite l’opportunité d’ajouter un nouveau motif de discrimination prohibée à l’article 10 de la Charte québécoise en discutant de la pertinence sociale d’une telle modification et en dressant certains parallèles avec l’ajout du motif de l’identité ou de l’expression de genre effectué en 2016.
