Freedom of Disassociation and Religious Communities: A Jewish Model for Associational Rights

"Freedom of association" as a right is a misnomer. Really, the right is about the "freedom of disassociation" and the right of one group to exclude individuals from the circle of its community or association. Granting the right to form a group, without granting the right of that same group to exclude others from the group, is a worthless right. Indeed, the proper contours of associational rights have been a significant problem in all democracies, as has been well demonstrated by the recent United States Supreme Court five to four decision in Boy Scouts of American v Dale (530 U.S 640 2000) -- deciding when a group has the right to exclude others remains a deeply deeply dividing issue in society. What makes these rights so problematic is that (unlike other rights) they involve an act of exclusion or expulsion towards another. In that sense the exercise of this right more directly impinges on other people's rights than for example, religious freedom rights or free speech rights. The first section of this paper will focus on the legal process Jewish law uses to form communities and to exclude people from its community. It will address the legal basis within Jewish law for the power to shun or excommunicate people and the goals of such a practice. It will then discuss the problems raised (internal to Jewish law) through the use of excommunication and shunning in a modern secular community where one's primary means of self-classification is not normally through religion. This paper will then address modern American, British and Canadian law responses to various religions excluding people from their sub-communities. A complete review of the problems posed in tort law will be provided, as well as recommendations for modification of tort law doctrines to allow for greater religious freedom to reinforce religious community values.The conclusion to this article notes that associational rights allowing the formation of religious sub-communities is not only fundamental to the ways in which a religious community forms itself, but profoundly compatible with general moral and legal notions of minority rights, and represents the most equitable way a religious community can form itself in a modern society. حق انجمن به‌عنوان یک حق، یک نام بی مسمی است. این حق را در واقع باید حق طرد دیگران نامید. به‌این معنی که یک گروه حق دارد بعضی افراد را در انجمن یا گروه اجتماعی خود نپذیرد. دادن حق به گروهی برای تشکیل یک انجمن بدون دادن حق نپذیرفتن افراد دیگر به همان گروه بی‌معناست. در عمل هم، مرز صحیح حقوق انجمن‌ها مشکل بزرگی در همه دموکراسی‌ها محسوب می‌شود. دشواری این موضوع را در تصمیم دیوان عالی ایالت متحده در پرونده پیشاهنگ‌های آمریکا علیه دیل(Dale) که با 5 موافق در مقابل 4 مخالف گرفته شد می‌توان مشاهده کرد. این‌‌که چه‌موقع یک گروه حق نپذیرفتن دیگران به گروه خود را داشته باشد همیشه تصمیم سختی بوده است و آن‌چه که باعث مسئله‌ساز شدن این حقوق شده آن‌است که دربطن این حقوق نپذیرفتن دیگران نهفته است بدین معنا که اعمال این حق بسیار بیشتر ازحقوقی مانند آزادی مذهب یا آزادی بیان با حقوق افراد دیگر ارتباط پیدا می‌کند. این مقاله در قسمت اول بر روش حقوقی که آیین یهود از آن برای تشکیل انجمن و طرد افراد دیگر از این انجمن‌ها استفاده می‌کند تمرکز می‌کند. این مقاله همچنین به بررسی مبانی حقوقی موجود در خود قانون یهود که به آنها حق نپذیرفتن دیگران را در انجمن هایشان می‌دهد می‌پردازد و هدف چنین رویه ای را بیان می‌کند و سپس به بررسی مشکلاتی می‌پردازد که اعمال چنین قانون‌هایی در جامعه مدرن و سکولار امروزی ایجاد می‌کند، جوامعی که عمده‌ترین شیوه برای تشکیل انجمن، معمولا دین محسوب نمی‌شود. در ادامه چگونگی برخورد قانون کشورهایی مثل کانادا، بریتانیا و آمریکا نسبت به ادیانی که از ورود دیگران به انجمن‌های خود خودداری می‌کنند مورد بحث قرار می‌گیرد. این مقاله هم‌چنین مرور کاملی خواهد داشت از مشکلات ایجاد شده در قانون مسئولیت مدنی و برای تصحیح آیین قانون مسئولیت مدنی پیشنهاداتی را ارائه می‌نماید تا امکان آزدی مذهبی بیشتر فراهم شود و ارزش‌های انجمن-های دینی افزایش یابد. این مقاله به‌عنوان نتیجه گیری یادآور می-شود که حق تشکیل انجمن که اجازه تشکیل انجمن‌های مذهبی را می‌دهد نه تنها برای شکل ‌گیری انجمن-های مذهبی یک مسئله حیاتی‌است بلکه با مبانی حقوقی و اخلاقی حقوق اقلیت‌ها کاملا هم راستاست و در واقع معرّف صحیح‌ترین شیوه برای تشکیل یک انجمن مذهبی در جامعه مدرن امروزی محسوب می‌شود.
