Abstract
Plusieurs situations appellent des mesures dites « punitives », soit ayant un effet matériel de sanctions, dans le dispositif d’aide sociale au Québec. Dans cet article, partant du cas de figure du contrôle des prestataires d’aide sociale en situation de vie maritale, nous montrerons que le droit administratif a pour effet de construire le profil du prestataire d’aide sociale comme un sujet déviant à punir. Notre recherche s’est notamment intéressée aux mécanismes juridiques déclenchés en raison de la supposée non-conformité aux règles du dispositif d’aide sociale en lien avec la vie maritale ainsi qu’aux effets de ces mécanismes punitifs sur les prestataires, à partir des récits d’expériences de ces derniers.
