La protection des sources journalistiques en droit civil québécois : une oeuvre inachevée

Abstract
Cet article propose une reflexion sur le regime quebecois de protection des sources journalistiques instaure a la suite des travaux de la Commission Chamberland et de l’adoption du nouveau regime de protection en droit de la preuve federal. Les auteurs s’interrogent sur l’etendue a accorder a la protection de l’identite d’une source confidentielle afin de reellement favoriser l’epanouissement de la liberte de presse, une liberte fondamentale. Dans cette optique, l’opportunite de creer un regime d’immunite relative applicable aux sources journalistiques en droit de la responsabilite civile quebecois est abordee. Les auteurs analysent les raisons pouvant justifier l’instauration de pareil regime et les conditions d’application qui pourraient etre mises en place afin d’assurer la coherence de son integration dans le systeme juridique civiliste quebecois.
