L’oralité devant le nouveau Tribunal judiciaire : une autonomie de la volonté renforcée pour un « procès à la carte »

Abstract
La dernière réforme de l’organisation judiciaire et juridictionnelle française renouvelle la question de l’oralité du procès civil. Par l’étude de la procédure orale applicable devant les juridictions de première instance françaises, l’oralité est questionnée au travers de sa fonction primaire qui est de permettre l’accès au juge ainsi que dans ses modalités d’organisation initialement centrées sur la présence des plaideurs. Le présent article analyse ainsi, dans un premier temps, le régime de la procédure orale dont les possibilités de recours à l’écrit et la prise en compte, accrue, de la volonté des justiciables en font une procédure de plus en plus aménageable à l’initiative du juge ou de ces derniers. Dans un second temps est questionné l’impact de l’extension de la représentation obligatoire et de la diversification des modes de résolution des conflits dans l’accès à la justice.
