Le système scolaire au Québec a été fondé et s’est structuré historiquement sur la base d’une division confessionnelle entre catholiques et protestants. Malgré tous les bouleversements qu’a connus la société québécoise depuis plusieurs décennies, la confessionnalité scolaire demeurait garantie par plusieurs paliers législatifs, dont la Constitution canadienne. En juin 2000, suite à un changement législatif, on a assisté à un processus accéléré de laïcisation du système scolaire et des structures de l’État qui en assuraient le fonctionnement. Les rapports de force séculaires entre l’Église et l’État se sont trouvés profondément transformés. Cet article présente les principales modifications qui affectent la place de la religion à l’école. Afin de mieux comprendre les enjeux autour de la déconfessionnalisation, j’analyse ensuite les deux conceptions des droits qui se sont affrontées à ce sujet lors des débats qui ont précédé l’adoption de la loi modifiant la place de la religion à l’école. Enfin, je décris la mutation des réseaux d’influence entre l’État et l’Église en comparant les débats qui ont entouré la création du ministère de l’Éducation en 1963 avec ceux qui se sont déroulés récemment. Enfin, je souligne ce que ces changements signifient dans l’aménagement du système éducatif.
