ANALISIS YURIDIS PERTANGGUNGJAWABAN ATC DAN MASKAPAI PENERBANGAN ATAS KECELAKAAN PESAWAT KEPADA PENUMPANG (Studi Kasus Pakistan International Airlines PK-8303)

Abstract
Pesawat Pakistan International Airlines PK-8303 mengalami kecelakaan yang mengakibatkan para penumpang meninggal. Kecelakaan tersebut disebabkan adanya kesalahan dan kelalaian dari pihak crew pesawat dan ATC. Akibat dari kecelakaan, maskapai dan juga pihak ATC diminta pertanggungjawaban berdasarkan hukum yang berlaku, tetapi pengaturan pertanggungjawaban ATC belum diatur dengan jelas. Penulisan hukum ini menggunakan metode pendekatan yuridis normatif . Analisis data menggunakan metode analisis kualitatif. Berdasarkan penelitian dasar hukum dari pertanggungjawaban ATC adalah Pasal 28 Konvensi Chicago 1944 di mana negara sebagai penyedia fasilitas navigasi penerbangan udara, sehingga secara tidak langsung bertanggungjawab atas tindakan yang dilakukan oleh pihak ATC. Mengenai pengaturan hukum mengenai pertanggungjawaban ATC, hal ini tidak diatur di dalam instrument hukum internasional sehingga pengaturan hukum dan bentuk pertanggungjawaban ATC diserahkan kepada negara. Sementara itu, pertanggungjawaban pihak maskapai adalah Pasal 17 Ayat 1 Konvensi Montreal 1999, di mana pihak maskapai dapat dimintakan pertanggungjawaban berdasarkan pasal tersebut, menggunakan prinsip strict liability yang artinya pihak maskapai bertanggungjawab secara mutlak apabila terjadi kecelakaan, sehingga pesawat tidak dapat melepaskan diri dari pertanggungjawaban akibat kecelakaan pesawat udara. Bentuk dari pertanggungjawaban maskapai kepada penumpang akibat kecelakaan pesawat udara adalah berupa ganti rugi dengan batas maksimal 100.000 SDR.
