Il contributo analizza le disposizioni contenute nel CETA in merito alle indicazioni geografiche, mettendo a confronto le soluzioni adottate in tale Accordo con quelle contenute nel TRIPS; al riguardo, il contributo cerca di evidenziare come le norma possano essere considerate nella pratica. Le analisi mettono in evidenza che il CETA, rispetto al TRIPS, aumenta il livello di protezione avvalendosi di un sistema di registrazione; nello stesso tempo, però, istituisce anche un regime di eccezioni che vanno ben oltre le soluzioni adottate dal TRIPS. In questo modo, il CETA crea un regime di norme con un alto livello di flessibilità, adottando praticamente tutte le tecniche precedentemente utilizzate dal TRIPS e utilizzando, inoltre, uno schema di asterischi per definire particolari denominazioni allo scopo di bilanciare gli interessi dei produttori europei rispetto a quelli dei titolari di marchi utilizzati in precedenza in Canada. Rimane il potenziale conflitto tra le protezioni fornite in base a diritti di marchi e alle norme sui generis delle IG, in quanto non si è riuscito a raggiungere un compromesso sul concetto di indicazione geografica.
