La distance est le maître-mot du contexte pandémique auquel la planète est confrontée depuis mars 2020. Elle s’est installée dans les relations humaines en conquérant les secteurs d’activité les plus divers. L’acte notarié, traditionnellement fondé sur le rapport présentiel entre les parties et le notaire, qui permet à ce dernier l’accomplissement de son devoir d’authentification personnelle, n’a pas échappé à un tel bouleversement. L’admission de la comparution des parties devant le notaire par visioconférence met à l’épreuve la notion d’authenticité jusque-là uniforme au sein du notariat latin. Le présent texte propose une réflexion sur les principaux enjeux de l’authenticité dématérialisée du point de vue de ses fondements et de la reconnaissance internationale de ses effets juridiques.
