Abstract
Le droit d’auteur français et le copyright américain définissent différemment les auteurs de cinéma et ne leur reconnaissent pas les mêmes droits. Cet article conteste les explications existantes de ces différences, qui les attribuent à des traditions juridiques nationales ou à des particularités des mondes du cinéma français et américain. Il explique la différenciation du droit de propriété cinématographique français et américain en examinant les relations entre le champ cinématographique, le sous-champ des experts de la propriété intellectuelle et les champs politique et bureaucratique. Il objective également plusieurs interdépendances entre les processus de définition du droit d’auteur et du copyright, qui tiennent au développement du droit international et aux concurrences dont il fait l’objet.
