Abstract
“Family status” is not a new protection for employees, but its application to childcare obligations has become much more prevalent in recent years. Care is labour that is essential to the functioning of society, and family has long been understood in terms of caregiving relationships. Significant changes in the nature of the family and of roles within family, have brought the issues facing workers with caregiving responsibilities to the fore. Most notably, women have entered the paid workforce in unprecedented numbers and demographic shifts have increased the need for eldercare. Given that caregiving obligations predominantly fall to women in Canada, family status discrimination is intertwined with sex discrimination and gender rights. Expansive human rights legislation and meaningful workplace accommodation efforts are key to addressing these changes.
