El proceso de Restitucion de tierras permite garantizar uno de los componentes de la reparacion integral, la restitucion, aunque este pro-ceso ha sido muy importante para las victimas en Colombia, fue concebido en el imaginario de que en cada caso existiria una victima y un victimario; sin embargo, la implementacion de la Ley ha mostrado que existen casos en los cuales los predios reclamados se encuentran habitados por personas que no participaron de los hechos que dieron origen al despojo y/o abandono forzado del reclamante, y que pueden verse afectados con un fallo de restitucion, caso en el cual, el Estado debe garantizar medidas en su favor. El presente articulo presenta un analisis del tratamiento que se les ha venido dado a los segundos ocupantes al interior del proceso de restitucion de tierras.
