Постановка проблеми. Сьогодні невирішеними є наукові завдання встановлення особистих немайнових прав здобувачів освіти як об’єкта посягання булінгу, визначення правових засад протидії булінгу в Україні, з'ясування міжнародного досвіду протидії булінгу як формі посягання на особисті немайнові права здобувачів освіти. Метою статті є визначення правових засад протидії булінгу як формі посягання на особисті немайнові права здобувачів освіти. Методи. Використовуються діалектичний, формально-правовий, порівняльно-правовий, системно-структурний, логіко-семантичний та інші методи наукового пізнання. Результати. Встановлено, що особисті немайнові права здобувачів освіти потребують системного захисту на рівні як законодавства, так і освітнього закладу, адже саме освітнє середовище закладає фундамент для формування особистості. Прояви булінгу як форми посягання на особисті немайнові права здобувачів освіти повинні бути ефективно зафіксованими, булери – покараними, а весь комплекс особистих немайнових прав здобувачів освіти захищеним та відновленим. В іноземних країнах існують різні моделі протидії булінгу як форми посягання на особисті немайнові права здобувача освіти. Законодавці до цього питання підходять по-різному: починаючи від закріплення відповідальності за цькування в освітньому закладі в конкретному нормативно-правовому акті, фрагментарне закріплення відповідальності в різних нормативно-правових актах, окрім цього впроваджується локальне регулювання цього питання в актах освітніх закладів, місцевого самоврядування та відсутність будь-якого регулювання. Показано, що досвід США, РФ, Швеції, Канаді, Франції, Білорусі та Казахстану свідчить, що передача повноважень із протидії цькуванню лише неурядовим організаціям позбавляє можливості притягнення винних до відповідальності. Висновки. Визначено, що найбільш вдалим із врахуванням захисту особистих немайнових прав здобувачів освіти, є досвід Швеції, де система протидії цькуванню поєднує імперативні норми (пряме закріплення санкції за булінг) й залучення освітнього закладу та батьків до мінімізації таких негативних випадків, а урядова програма цієї країни спрямована на благополуччя сім’ї та забезпечення комфортних, довірливих стосунків всередині освітнього колективу. В Україні наявною є низка проблем щодо врегулювання питання протидії булінгу, зокрема відсутня узгодженість між нормативно-правовими актами, які регулюють питання захисту особистих немайнових прав здобувачів освіти з питання поіменованості цих прав у різних нормативно-правових актах, відсутні алгоритми взаємодії освітніх закладів з батьками/усиновлювачами, представниками жертви булінгу, громадськими організаціями. Це надає підстави вважати булінг невирішеною проблемою для вітчизняного освітнього середовища з врахуванням потреби захисту особистих немайнових прав здобувачів освіти. Problem statement. Today, the scientific tasks of establishing the personal non-property rights of education seekers as an object of bullying, defining the legal basis for combating bullying in Ukraine, clarifying the international experience of combating bullying as a form of encroachment on the personal non-property rights of students are unsolved. The purpose of the article is to define the legal basis for combating bullying as a form of encroachment on the personal intangible rights of students. Methods. Dialectical, formal-legal, comparative-legal, system-structural, logical-semantic, and other methods of scientific cognition are used. Results. It is established that the personal intangible rights of students need systematic protection at the level of both legislation and educational institution because the educational environment itself lays the foundation for the formation of personality. Manifestations of bullying as a form of encroachment on the personal non-property rights of students should be effectively recorded, bullies – punished, and the whole set of personal non-property rights of students protected and restored. In foreign countries, there are various models of combating bullying as a form of encroachment on the personal intangible rights of the learner. Legislators approach this issue in different ways: from consolidating responsibility for harassment in an educational institution in a specific legal act, fragmentary consolidation of responsibility in various legal acts, in addition, local regulation of this issue is introduced in acts of educational institutions, local government and lack of any regulation. It is shown that the experience of the USA, Russia, Sweden, Canada, France, Belarus, and Kazakhstan shows that the transfer of anti-bullying powers only to non-governmental organizations deprives the perpetrators of the possibility of prosecution. Conclusions. It is determined that the most successful, taking into account the protection of personal non-property rights of students, is the experience of Sweden, where the system of combating harassment combines mandatory rules (direct sanction for bullying) and involving educational institutions and parents to minimize such negative cases. for the well-being of the family and ensuring comfortable, trusting relationships within the educational team. In Ukraine, there are a number of problems in resolving the issue of combating bullying; in particular, there is no coherence between regulations governing the protection of personal non-property rights of students on the naming of these rights in various regulations, there are no algorithms for interaction with parents / adoptive parents, representatives of the victim of bullying, public organizations. This gives grounds to consider bullying an unresolved problem for the domestic educational environment, taking into account the need to protect the personal non-property rights of students.
