A educação como um direito público instaura uma nova ética que reconhece a diferença e possibilita o movimento de luta pela inclusão de alunos com deficiência. Esse estudo objetivou analisar comparativamente a política educacional do Brasil e do Canadá, especificamente no Distrito de Ontário, a partir dos documentos legais voltados para a Educação Especial. Metodologicamente, situa-se na área da Educação Comparada. Ao confrontar os documentos e normativas dos dois países, ficam evidentes as semelhanças e as diferenças. Os dois países apresentam diretrizes e normativas próprias para a educação especial, mas se distanciam nos programas de suporte. O principal ponto de aproximação se dá pelo processo de escolarização das pessoas com deficiência no ensino comum, porém a política brasileira enfrenta grandes desafios para garantir esse direito. Quanto aos distanciamentos entre a legislação brasileira e a canadense destacam-se: a organização dos serviços; a governança de sistemas de educação; a articulação entre as políticas sociais e as políticas educacionais; os diferentes sistemas de apoio; e o direcionamento dos recursos públicos. A proposição final deste texto é que a escola comum deve ser lugar de todos os alunos e que o Estado deve estar comprometido em garantir a escola pública para todos.
