Abstract

Le champ d’application de la législation sud-africaine sur les congés et les prestations de sécurité sociale pour les parents salariés a été élargi en 2018. Cette contribution a pour objet de comparer le cadre législatif résultant de cette modification aux dispositions de la directive 2019/1158/UE. La comparaison est basée sur quatre droits et principes constitutionnels sud-africains qui correspondent à ceux qui sous-tendent la directive. On constate que l’équilibre entre vie professionnelle et vie privée des parents et des aidants n’a pas reçu l’attention nécessaire dans le programme législatif sud-africain, malgré la générosité de la Constitution. Les décideurs politiques et les législateurs sud-africains pourraient s’inspirer des dispositions de la directive 2019/1158 sur le congé parental et la garde d’enfants pour élaborer un cadre sud-africain unique visant à assurer l’équilibre entre vie professionnelle et vie privée pour les parents et les aidants.
