Artiklen behandler ministeransvarets erstatningsretlige aspekter i historisk og aktuelt lys. Det dokumenteres, at spørgsmål om erstatningsansvar siden junigrundloven af 1849 principielt har været en integreret del af ministeransvaret. Det konkluderes med afsæt i ministeransvarlighedslovens § 9 og med eksempler fra (rigs)retspraksis, at spørgsmål om ministres erstatningsansvar er reguleret af de almindelige erstatningsregler, og at de materielle betingelser for, at ministre kan ifalde personligt ansvar, herunder i form af regres, principielt er til stede. Dernæst konkluderes, at Rigsretten er enekompetent til at tage stilling til statskassens erstatningskrav mod ministre i anledning af deres embedsførelse. At privates erstatningskrav normalt rettes mod statskassen og forfølges ved de almindelige domstole, er i overensstemmelse med grundlovens § 63 og principper for offentlige myndigheders erstatningsansvar. Det påpeges dog, at Rigsretten næppe er inkompetent over for privates erstatningskrav i anledning af ministres embedsførelse, og at disse må indtales i rigsretssagen efter adhæsionsprocessens principper. I forlængelse heraf argumenteres for, at Rigsretten tilmed er enekompetent til at pådømme ministres personlige erstatningsansvar, og at Rigsretten i forbindelse med en rigsretsprocedure også vil kunne tage stilling til statens hæftelsesansvar. Efterfølgende overvejes, hvordan retsplejelovens regler om adhæsionsprocessen spiller sammen med rigsretsloven i forbindelse med pådømmelse af erstatningsspørgsmål. Til sidst anbefales en reform af reglerne bl.a. med henblik på i videst muligt omfang at fjerne spørgsmål om ministres erstatningsansvar fra ministeransvarlighedsinstituttet.
