Le mouvement « droit et littérature », initié par des juristes soucieux d’éclairer leur pratique par des exemples littéraires qui mettent en scène le droit, va aujourd’hui bien au-delà de ce qu’ont imaginé ses pionniers américains. Cette école de pensée, née aux États-Unis au début du xx e siècle, illustre tantôt le droit dans la littérature, la littérature face au droit (procès d’écrivains, censure), tantôt le droit comme littérature ou même le droit par la littérature. En effet, l’énonciation littéraire, en mettant l’accent sur des communautés discursives, des évolutions sociales, des représentations collectives, ne se contente pas de représenter la justice, elle la problématise, lui donne vie, l’inquiète, voire la modèle. Ce dialogue disciplinaire se nourrit entre autres de similitudes méthodologiques ; de la production des textes à leur lecture, la littérature fait usage de récits, s’interroge sur l’interprétation, comme le droit. À partir de cette interaction se développe une histoire très différente du mouvement aux États-Unis et en Europe : des contextes historiques, littéraires et enfin théoriques permettent d’expliquer l’intérêt tardif de l’Europe pour cette tendance qui se développe dans les années 1990-2000 sur le continent. L’invention du genre de la jurisfiction, en élargissant les perspectives sur la pratique du droit, donne une nouvelle dimension à ce courant de pensée et en confirme la valeur heuristique.
