Abstract
Si l’accès à une contraception efficace a permis une sexualité sans procréation, les techniques de procréation assistée ont rendu possible la fragmentation de la maternité. Ainsi, grâce à l’aliénation (don) de gamètes, à la fécondation in vitro et à la congélation d’ovules et d’embryons, la procréation peut se produire hors du corps, hors du couple et hors du temps. Bien que ces techniques aient permis à des personnes infertiles de devenir parents, la fragmentation a causé une perte de contrôle des femmes sur leurs corps. Une analyse de trois situations de procréation assistée encadrées par le droit québécois et canadien démontre qu’elles conduisent à l’effacement des femmes. Cette situation est assez paradoxale, puisque toutes les techniques se déploient dans le corps des femmes et qu’ultimement, la grossesse se déroule aussi dans leur corps. La présente analyse se fonde sur un cadre théorique féministe appliqué au droit.
