Las migraciones suponen un reto trascendente para el ordenamiento jurídico por variadas razones. En el caso particular del sistema de derecho tributario el impacto es notable, en tanto los mecanismos previstos por esta rama del derecho en el proceso de exacción fiscal responden mayoritariamente a situaciones sociales con comportamientos demográficos visiblemente distintos a los que la contemporaneidad describe. Ergo, las adaptaciones de las instituciones tributarias como sujetos, objetos, carácter de la relación tributaria, ampliación de la territorialidad, moderación del poder tributario, cesión de competencias a otros Estados, enfoque cooperativo en la recaudación se han transformado al influjo del derecho internacional. Ahora bien, las garantías y los derechos de los contribuyentes en el caso del migrante/contribuyente circular suponen uno de los retos más peculiares para el sistema de derecho tributario, en tanto esta figura cobra auge e importancia en las sociedades contemporáneas, ora como ente dinamizador en la economía interna o como sujeto desprovisto de una protección adecuada por el derecho tributario en particular y financiero en general. Este trabajo esboza los desafíos fundamentales de la figura para el derecho tributario y pauta algunos nodos epistémicos para el desarrollo teórico-normativo de la figura.
