Abstract
Tujuan penelitian ini, yaitu untuk mengkaji dan menganalisis tentang (1) substansi kode etik notaris, baik yang tercantum dalam Kode Etik INI 2005 maupun Kode Etik INI 2015, (2) substansi kode etik notaris yang tercantum di dalam kode etik notaris pada Negara Bagian Georgia, Amerika Serikat dan Code of ethics of notaris provinsi Québec, Kanada, (3) perbedaan dan persamaan substansi kode etik notaris yang berlaku di Indonesia dan Negara lain. Metode yang digunakan disajikan berikut ini. Jenis penelitian ini, yaitu penelitian hukum normatif. Pendekatan yang digunakan dalam penelitian ini, yaitu (1) pendekatan undang-undang (statute approah), (2) pendekatan konseptual (conceptual approach), dan (3) pendekatan komparatif . Sumber datanya berasal dari data kepustakaan, dan bahan hukumnya, yaitu bahan hukum primer, sekunder dan tertier. Teknik pengumpulan datanya, menggunakan studi dokumenter. Analisis datanya, menggunakan analisis kualitatif. Hasil penelitian, disajikan berikut ini. 1. Substansi yang dimuat dalam Kode Etik Notaris Ikatan Notaris Indonesia adalah tentang (1) kewajiban, larangan, sanksi, dan tata cara penegakan kode etik notaris. 2. Substansi yang diatur dalam kode etik notaris pada Negara Bagian Georgia, Amerika Serikat adalah tentang kewenangan notaris, kewajiban notaris, dan hubungan antara notaris dengan pihak lainnya. 3. Substans pokok yang dimuat dalam Code of Ethics of Notaris di Provinsi Québec, Kanada adalah tentang kewajiban dan tanggung jawab notaris dalam melaksanakan kewajiban. Persamaan substansi kode etik yang tercantum dalam ketiga kode etik notaris di atas, yaitu memuat tentang kewajiban notaris. Sementara itu, yang berbeda adalah berkaitan dengan larangan, sanksi dan tata cara penegakannya.
