Abstract

This work aims to make an assement of the economic constitution in the european legal system. The failure of the Constitutional Treaty and the way out to the european constitutional crisis are the framework of this reflection. The attenuation of the universal contents in the future Union treaty and the decisive weight the economic dimension has in the the Treaty of Functioning of the European Union causes the economic constitution to become the core of the european constitutionalism. The alter is domed with an absorbent caracter with regard to the whole legalsystem and invades the constitutional ordel of the member States. The ordoliberal tradition still contines inspiring the Economic constitution in opposition to the Social State. The inclusion of social contents from the Amsterdam reform does not change the accused centrality and social subordination to it. From this perspective, the European legal system is configured as the constitutional level to extend the new material constitution of the market state sanctioning the breakdown of the Social State.
