Reevaluating Fair Use in China — A Comparative Copyright Analysis of Chinese Fair Use Legislation, the U.S. Fair Use Doctrine, and the European Fair Dealing Model

Abstract
This article is the first to focus on China in comparing and discussing the divergence of fair use doctrine in the U.S., with the fair dealing model commonly found in the Commonwealth countries (the U.K. and Canada), Europe and China. Drawing on different outcomes of the Google thumbnail litigation in various countries, the article discusses pros and cons of the fair use doctrine under the U.S. system and the fair dealing model in the rest of the world. In the end, the article proposes a number of fair use/fair dealing models that the Chinese government might consider in its legislative reform.
