Ce texte commente le jugement France Télécom en insistant sur le rôle significatif qu’y joue la psychodynamique du travail sous deux aspects : d’une part, l’importance de cette discipline dans le raisonnement juridique relatif à des points litigieux, notamment la portée du harcèlement institutionnel et de la politique d’entreprise en matière pénale et, d’autre part, son apport essentiel dans l’élaboration de la grille d’analyse qui sous-tend la qualification juridique des faits de la cause. Cette contribution se manifeste particulièrement dans l’attention que le jugement accorde au collectif de travail, à la souffrance, la domination et la banalisation du mal. Le texte se termine sur quelques observations relatives aux limites de la procédure judiciaire, en l’occurrence pénale, s’agissant de la transformation des aspects structuraux relatifs à l’organisation managériale du travail et la financiarisation des entreprises.
