Australian double tax treaties are negotiated by government representatives and a final draft is initialled. The treaty is then included as a schedule to a bill for amendment to the Domestic Income Tax Act 1953, as amended. Australian treaties are normally structured to become operative once notes are exchanged by the relevant governments through diplomatic channels notifying that all procedures have been completed to give the agreements the force of law in both countries. In Canada, treaty making power is exercised by the Governor-General in Council on the advice of the Canadian ministers and, in particular, the minister responsible for foreign relations. The usual procedure is to enact legislation that incorporates the text of the signed treaty in a schedule. The legislative enactment proceeds along the normal route requiring approval by the House of Commons and the Senate and Royal Assent.
