Abstract
Niet-aanvaarding van redelijke wijzigingsvoorstellen In deze bijdrage staat de auteur stil bij de betekenis van het Stoof/Mammoet-arrest. Hij bespreekt de daarin gegeven uitwerking van de Taxi Hofman-leer en gaat in op de visie van de Hoge Raad op de verhouding tussen de op goed werknemerschap gebaseerde medewerkingsplicht van de werknemer en art. 7:613 BW. Vervolgens behandelt hij een aspect van de problematiek waarover de Hoge Raad zich in het Stoof/Mammoet-arrest niet, althans niet expliciet heeft uitgelaten, te weten: de gevolgen van een weigering van de werknemer om een redelijk voorstel van de werkgever dat verband houdt met gewijzigde omstandigheden op het werk te aanvaarden, terwijl voor die weigering geen deugdelijke gronden bestaan. In zijn optiek hebben de door de Hoge Raad in het arrest geformuleerde uitgangspunten op dit punt belangrijke consequenties, die in de lagere jurisprudentie na het arrest vaak niet in acht worden genomen.
