Des observateurs autochtones et non autochtones estiment que la création éventuelle d’un État québécois souverain ne saurait mettre fin à la relation entre le Canada et les peuples autochtones vivant au Québec sans leur consentement. Prenant en considération les leçons et les modèles qu’offrent les précédents internationaux, en particulier l’expérience européenne, cet article étudie les procédés institutionnels et juridiques qui permettraient, dans l’hypothèse d’un vote référendaire clairement favorable à l’indépendance du Québec, de concilier cette volonté de sécession avec la décision éventuelle de certains peuples autochtones du Québec de conserver leur lien avec le Canada. La négociation d’une entente constitutionnelle et internationale assurant la continuité canadienne pour les autochtones du Québec qui en feraient la demande sera présentée comme une voie privilégiée de conciliation des choix collectifs exprimés, sans nécessairement devoir modifier les frontières du Québec. Les auteurs proposent une définition du champ de la continuité canadienne, décrivent les aspects originaux de l’entente proposée et expliquent les éléments essentiels du régime juridique qui serait mis en place par une telle entente.
