Abstract
O artigo possui como escopo a demonstração da inocorrência da prescrição das pretensões individuais indenizatórias no Desastre do Rio Doce, em razão da ação coletiva e da autocomposição como causas, respectivamente, de interrupção e de suspensão do prazo prescricional para ações individuais advindas desse desastre, ocorrido devido ao rompimento da barragem de Fundão, em Mariana. A conduta das empresas, que gerou enorme insegurança jurídica, é destacada. Ao final, salienta-se como o caso em estudo tornou-se importante precedente persuasivo para futuros casos análogos, e também a existência de atuais projetos de lei pertinentes ao regime da prescrição na ação coletiva.
