El crecimiento del transporte aéreo internacional ha determinado que las cuestiones relacionadas con el retraso sean las que más a menudo afectan a los usuarios del servicio. La legislación de los Estados debe ser consistente y coherente con los Tratados Internacionales respecto de la responsabilidad de las aerolíneas establecida por el Convenio de Montreal de 1999. La escasa regulación de protección al consumidor en el transporte aéreo internacional de pasajeros en Latinoamérica es dispar entre los países y ajenas a las normas de carácter internacional que regulan los derechos de protección al consumidor. No debe haber discusión alguna entre la seguridad y la protección de los derechos de los pasajeros para exonerar a las aerolíneas de responsabilidad por retrasos o cancelaciones causados por circunstancias de seguridad. Ello en razón que el bien jurídicamente protegido es la seguridad de vuelo. Los progresos que se logren deben en materia de protección al consumidor no deben afectar indebidamente a las aerolíneas, de cuya prosperidad también depende la prestación de un servicio adecuado para el consumidor. Existen un sinnúmero de circunstancias y procesos que escapan al control de las aerolíneas, no pareciendo razonable que, en estos casos, deban responder civilmente. Adoptar una posición contraria solamente contribuye a generar costos adicionales y a incrementar el costo del servicio, dificultado su acceso para aquellos usuarios quienes presenten mayor sensibilidad a la elasticidad de la demanda.
 ABSTRACT
 The growth of international air transport has determined that delay issues are the ones that most often affect service users. The legislation of the States must be consistent and coherent with the International Treaties regarding the responsibility of airlines established by the Montreal Convention of 1999. The scant regulation of consumer protection in international passenger air transport in Latin America is uneven among the countries. countries and outside the international standards that regulate consumer protection rights. There should be no discussion between safety and the protection of passenger rights to exonerate airlines from liability for delays or cancellations caused by safety circumstances. This is because the legally protected asset is flight safety. Progress in consumer protection must not unduly affect airlines, on whose prosperity the provision of adequate consumer service also depends. There are countless circumstances and processes that are beyond the control of the airlines, and it does not seem reasonable that, in these cases, they should respond civilly. Adopting a contrary position only contributes to generating additional costs and increasing the cost of the service, making access difficult for those users who are more sensitive to the elasticity of demand.
