La Section 2(a) de la Charte canadienne des droits et libertes garantit la liberte de religion. La jurisprudence canadienne, jusqu'a ce jour, semble assurer cette liberte en tout lieu public au Canada, mais la definition de la liberte de religion et son expression publique sont encore faconnees par le droit jurisprudentiel. Dans le but de faciliter l'interpretation juridique dans ce contexte, l'A. soutient que la reference a la « suprematie de Dieu » dans le preambule de la Charte ne devrait pas etre concue comme etant « lettre morte » mais plutot comme un principe fondamental qui, de pair avec la « regle du droit », constitue un horizon selon lequel l'expression religieuse publique et les autres valeurs de la Charte doivent etre interpretees. L'A. expose quelques cas canadiens qui ont defini la « liberte de religion » et en etablit les limites d'expression publique. L'A. s'attarde ensuite a de nombreux cas dans lesquels les tribunaux ont du etablir un equilibre entre les revendications de liberte religieuse d'une part et le droit a l'egalite de la section 15 de la Charte d'autre part. Bien qu'au niveau de la regle du droit positif, il n'y ait pas de hierarchie des droits ou des « biens » de la Charte qui definisse l'horizon du'sens de la societe, l'A. maintient qu'il est essentiel de definir les engagements fondamentaux qui ont forme l'horizon meme duquel ont emane les garanties de la Charte. Le preambule de la Charte discerne expressement cet horizon aussi bien dans la regle de droit que dans la suprematie de Dieu. En plus de la raison (la regle de droit), il faut aussi considerer le niveau transcendantal de la foi et le rapport personnel avec le divin (Dieu) qui oeuvrent ensemble dans la poursuite vitale de toute personne, voire de toute nation, de sa veritable identite et de son epanouissement. C'est dans cette perspective que la liberte de religion doit etre interpretee et mise en equilibre avec les revendications de la Charte.
