Abstract
O instituto do foro especial por prerrogativa de função é previsto na Constituição Federal em um rol taxativo para seus detentores, este instituto evoluiu com o tempo e sofreu mudanças significativas com o passar das Constituições, porém, ainda assim podem ocorrer equívocos no tocante a sua aplicação o que gerou a necessidade de uma delimitação do mesmo. A questão norteadora deste artigo consiste em saber como ocorreu a evolução do instituto do foro por prerrogativa no nosso ordenamento jurídico ao longo do tempo e como ele é aplicado no atual cenário brasileiro. Desta forma, este artigo busca analisar o instituto do foro especial por prerrogativa de função no ordenamento jurídico brasileiro em face de evolução temporal e os desdobramentos legais de sua aplicação, apresentando como objetivo realizar um estudo sob o instituto, passando pela sua evolução nas constituições brasileira, no princípio constitucional da isonomia e no marco acerca de sua aplicação, que foi do julgamento da Ação Penal nº 937 pelo STF. Foi adotado para tal um estudo de revisão bibliográfica, onde foram utilizados artigos científicos, obras acadêmicas e literárias. Como resultado da pesquisa foi possível comprovar que embora, muitas vezes, tendo sua interpretação e aplicação equivocada, o instituto, pode ser eficaz desde que seguido à risca os casos que a Constituição abarca em seu texto.
