Abstract
The duty of abstention of a public official in matters where personal interest is presumed, either direct or because they affect family or friends, is a fundamental rule of the bureaucracy subject to the “rule of law" or more precisely to the law; it is essential to eliminate the opportunity for corrupt behavior that puts particular interests before general interests. However, in a study conducted on a representative sample of the Spanish population, less than 1/3 of the population endorses this behavior as “mandatory”. In this article we try to understand and explain these data. Although we show that some variables partially explain this response, it seems that a more detailed investigation is necessary to explain why 2/3 of the population does not endorse the duty of abstention as a public official when there is a potential conflict of interest
