Abstract
Lorsque, dans une convention collective, rien n'établit les conditions selon lesquelles l'ancienneté doit être computée, ou ne peut raisonnablement soutenir que l'expression « années de service » réfère uniquement à celles écoulées depuis la mise en vigueur de la convention. Dans un tel cas, la convention elle-même ferait perdre à un ou plusieurs employés des droits acquis. On doit donc tenir compte de l'ancienneté accumulée avant l'entrée en vigueur de la convention.
